Terms of Service

These Terms of Service ("Terms") govern your use of the Cerrar platform available at cerrar.me (the "Service"), operated by Cerrar ("we," "us," or "our"). By accessing or using the Service, you agree to be bound by these Terms.

1. Service Description

Cerrar provides an AI-powered lead qualification platform. The Service enables users ("Coaches") to create AI interview funnels that automatically qualify leads through conversational AI, generate lead scores, and produce pre-call briefs.

2. Account Registration

  • You must provide accurate and complete information when creating an account.
  • You are responsible for maintaining the security of your account credentials.
  • You must be at least 18 years of age to use the Service.
  • One person or entity may not maintain more than one account.
  • You are responsible for all activity that occurs under your account.

3. Acceptable Use

You agree not to:

  • Use the Service for any illegal or unauthorized purpose
  • Transmit harmful, offensive, or misleading content through AI funnels
  • Attempt to bypass rate limits, security measures, or access controls
  • Reverse engineer, decompile, or disassemble any part of the Service
  • Use the Service to collect data in violation of applicable privacy laws
  • Resell access to the Service without written permission
  • Interfere with or disrupt the Service or its infrastructure

4. Payment Terms

  • Paid plans are billed monthly via Stripe.
  • All fees are in USD and are non-refundable except where required by law.
  • You authorize us to charge your payment method on a recurring basis.
  • We may change pricing with 30 days' notice. Continued use after a price change constitutes acceptance.
  • Free trial accounts are limited to 1 funnel. Trial periods last 14 days from account creation.
  • If payment fails, we may suspend your account after reasonable notice.

5. Data Usage & Ownership

  • You retain ownership of all content you submit to the Service (funnel configurations, branding, etc.).
  • Lead conversation data is generated through the Service and belongs to you.
  • You grant us a limited license to process your data as necessary to provide the Service.
  • We may use aggregated, anonymized data to improve the Service.
  • Our handling of personal data is described in our Privacy Policy.

6. AI-Generated Content

The Service uses third-party AI models (Google Gemini, Anthropic Claude) to generate conversational responses. AI-generated content may not always be accurate, complete, or appropriate. You are responsible for reviewing AI outputs and configuring your funnels appropriately for your audience.

7. Availability & Support

  • We strive for high availability but do not guarantee uninterrupted service.
  • We may perform maintenance that temporarily affects availability.
  • Support is provided via email at carter@cerrar.me.
  • Enterprise plans may include SLA guarantees as specified in a separate agreement.

8. Limitation of Liability

To the maximum extent permitted by law, Cerrar shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or business opportunities, arising from your use of the Service.

Our total liability for any claim arising from or related to the Service shall not exceed the amount you paid us in the 12 months preceding the claim.

9. Indemnification

You agree to indemnify and hold harmless Cerrar and its officers, directors, employees, and agents from any claims, damages, or expenses arising from your use of the Service, your violation of these Terms, or your violation of any rights of a third party.

10. Termination

  • You may cancel your account at any time from your account settings.
  • We may suspend or terminate your account for violations of these Terms with reasonable notice.
  • Upon termination, your access to the Service will cease and your data will be deleted within 30 days.
  • Sections 8, 9, and 11 survive termination.

11. Governing Law

These Terms are governed by the laws of the State of Utah, United States, without regard to conflict of law principles. Any disputes shall be resolved in the courts of Utah.

12. Changes to These Terms

We may modify these Terms at any time. We will notify you of material changes by posting the updated Terms on this page and updating the "Last updated" date. Continued use of the Service after changes constitutes acceptance.
